''Armaan sir, before you leave- I want to ask you a question'' Abhira stood up from her seat, her gaze as sharp as a blade.
''Ask'' Armaan replied not eyeing her.
''Sir lets take a case- A is a driver and B is a biker. A hit B with his car and rushed to see B lying on the other side of the road. But due to fear of police, he did not help B to get stable and ran away. A's lawyer C defended A telling that A was scared and his intention to hit B wasn't there plus B was riding his bike quite harshly. B is paralyzed and now is unable to walk. Doctors said that he will be unable to walk. B's lawyer D proves that case is of a hit and run but C suggests for out of court settlement. Is contention of C correct? Should A be charged for hit and run case and be jailed?''
Armaan for a moment was taken aback- shocked by the question.
''The contention of C, A's lawyer, is partially correct regarding the lack of malicious intent," Before Armaan could answer- Digvijay answered stepping into the classroom. He was a lecturer too- a guest lecturer like Armaan.
''If you permit may I continue?'' He asked politely and Armaan nodded.
"However, the act of leaving B injured and unattended, knowing the severity of his condition, is a critical factor. The CCTV footage is damning evidence of A's negligence. While the harsh riding of B might be considered mitigating evidence, it cannot justify A's abandonment of his civic and moral responsibility. The act itself, irrespective of initial intent, constitutes a serious offense." he continued observing the students.
Then with a subtle shift in his tone, he added a twist. "What if, hypothetically, B had some pre-existing condition, aggravated by the accident, making A's culpability even more significant? Such a twist could drastically alter the sentence. But considering that- B was a healthy man before the accident, he was fit then, A will face the consequences of his actions. About A's punishment.." Digvijay said, addressing Abhira's core question. "That's for the court to decide, considering the totality of circumstances and evidence. The out-of-court settlement suggested by C is a possibility but, morally speaking, A bears considerable responsibility for B's paralysis. His fear, though understandable, doesn't absolve him of his actions. The severity of the consequences, the undeniable evidence, and the potential for additional culpability if pre-existing conditions were factored in, strongly suggest a jail sentence for ten years with fine. Furthermore," he added, a glint in his eyes, "consider the message it sends to society. Leaving someone injured due to your actions would set a dangerous precedent if not met with suitable punishment. Justice shouldn't solely focus on intent; it must also consider the consequences and responsibility." Digvijay concluded and everyone nodded in response.
''Sir you are right! We all agree.'' Students replied.
''If you don't mid sir, can I twist and add a sentence?''
''Sure'' Digvijay replied.
''What if A is C's family member?''
''That does not change the facts. Whether a family member or a stranger- offender is an offender. Even if the offender is some hotshot businessman or an MLA or MP then also he will face the consequences but sadly-- they are excused on the basis of their high position. Law is equal to all. Lawyers are supposed to fight for the truth- unbiased. It will be foolish of C and he will be termed morally, ethically wrong for supporting a criminal.''
Armaan stood aghast and then lowered his head. He was clearly ashamed and embarrassed.
''By the way- class is for half an hour only. We will wrap up today's chapter and then you all can go home!'' Digvijay exclaimed.
All cheered and Armaan slipped out from the room, not meeting Abhira's eyes. He was too embarrassed to speak.
After the class was over, Abhira remained in class while Digvijay arranged his notes.
''You wanted to teach him a lesson don't you?'' Digvijay questioned meeting Abhira's gaze.
''It was not entirely my plan, you wanted my ex to sweat! A student is expected to obey the teacher. By the way- am your student as well as your wife, sir so I obeyed'' Abhira replied confidently and Digvijay laughed.
''Wife at home, student in college and a fellow lawyer in court of law- MRS.ABHIRA SHARMA MAHAJAN''
