By participating in the Tim Hortons "#TimsEspressYourself Short Story Contest" ("Contest"), each entrant agrees to be bound by these Official Rules and the decisions of The TDL Group Corp. ("Tim Hortons") and Wattpad Corp. ("Sponsor"), which are final and binding in all matters.

1. HOW TO ENTER: NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

To participate in the Contest, you must submit your entry of a short story inspired by Tim Hortons through Wattpad.com ("Website") during the period beginning at 9:00 a.m. EST on November 15th, 2021 through 11:59 p.m. EST on December 13th, 2021 ("Entry Period"). Visit the brand profile Wattpad.com/user/TimHortons (the "Contest Profile"), and follow the instructions provided ("Instructions") on how to submit your entry inspired by an Espresso-themed story, initially developed by a designated Wattpad Star (the "Wattpad Star") (each, an "Entry"). Each Entry must be received within the part-specific timeline to be eligible: Part 1 - November 22nd 11:59 a.m. EST to November 28th at 11:59 p.m. EST, Part 2 - November 30th at approximately 11:59 a.m. EST to December 5th 11:59 p.m. EST, Part 3 – December 7th at approximately 11:59 a.m. EST to December 12th 11:59 p.m. EST, and Part 4 - December 14th at approximately 11:59 a.m. EST to December 19th 11:59 p.m. EST. Eligible entrants may enter as many times as they wish (with unique Entries) during the Entry Period. If you do not already have a Website account, you will be required to create one in order to enter. Creating an account is free as of the publication of these Official Rules. All Website terms and conditions apply. Accounts or Entries generated by script, macro or other automated means will be void. Website's clock will be the official time-keeping device for the Contest.

All Entries must meet the following criteria:

● Entry must be in English, original and may not exceed the comment character limitations (2,000 characters), as reflected in the Sponsor platform (the "Platform") desktop experience. Entrant must have all rights necessary to post and submit each Entry. Entry must not infringe on the intellectual property or other rights of any third party. It is each entrant's responsibility to ensure that they have all necessary rights to submit the Entry (with the exception of any rights associated with Sponsor) and to grant Sponsor and Administrator the rights described in these Official Rules.

● Entry (or any fictional story that is, in the opinion of the Sponsor, substantially similar to the Entry) must not have been submitted to any other contest, or previously published.

● Entries must be submitted through your Website account in the manner specified on the Contest Profile.

● Entries must comply with all Instructions specified on the Contest Profile (incorporated herein by reference).

● Entries must not contain identifying information (e.g., names, addresses, phone numbers, email addresses or mailing addresses) of any real person, including entrant.

● Entries must not contain material that is obscene, lewd, disparaging, defamatory, libelous, threatening, pornographic, sexually explicit, racially or ethnically offensive, or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole discretion, or that encourages conduct that would be considered a criminal offense, give rise to civil liability, or violate any law. Entries must be appropriate for viewing by the general public; appropriateness will be determined by Sponsor at its sole discretion.

● Entries must not disparage the goodwill and business reputation of Tim Hortons or any of its content licensors.

● Entries must be relevant to the Contest theme.

● Entries must be tagged #TimsEspressYourself to be considered.

Sponsor reserves the right to reject any Entry for any reason.

2. ELIGIBILITY: Open to legal residents of Canada (excluding Quebec), who are at least 13 years of age. In the event an entrant is a minor, such entrant must obtain written permission from their respective parent or legal guardian, who has agreed on such minor's behalf as well as their own behalf to be bound by these Official Rules. Entrants must agree to the terms and conditions of Sponsor's Terms of Service, a copy of which can be found on the Website. Employees of Sponsor, Tim Hortons, each of their respective parent corporations, affiliates, subsidiaries, and advertising, promotion, and fulfillment agencies, and their immediate family members (spouse and parents, children, siblings and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate in the Contest. Contest is void where prohibited. All applicable federal, provincial and local laws apply.

3. WINNER SELECTION: For a total of four (4) weeks, one (1) winning Entry per week will be selected by the Wattpad Star, from all eligible Entries received during that week's corresponding entry period. Winning Entries will be selected based equally on creativity, originality, relevance to the story themes and Tim Horton's guidelines (25% / 25% / 25% / 25%). A total of four (4) winning Entries will be selected by the end of the contest on December 20th, 2021. Scores will not be revealed. The decision of the Wattpad Star is final.

4. WINNER NOTIFICATION/REQUIREMENTS: One (1) winner will be selected by the Wattpad Star within 24 hours of the submission deadline for each part , for a total of four (4) winners (each a "Prize Winner" and collectively, "Prize Winners"). Prize Winners will not be eligible to win more than one (1) time per Contest. Sponsor or an agent of Sponsor will attempt to notify the potential Prize Winner(s) by email or direct message on Sponsor's Website within 48 hours of selection. The potential Prize Winners (or their parent or legal guardian if they are a minor) will be required to correctly answer, without assistance of any kind, a timed mathematical skill-testing question administered by telephone, video conference, or email. The potential Prize Winners (or their parent or legal guardian if they are a minor) will be required to execute and return a notarized Declaration of Eligibility and Release (the "Declaration and Release") form within seven (7) days of date of notification. Winning Entries will be added to the public story upon such notification and may be added prior to Prize Winner, or their parent or legal guardian, signing a Declaration and Release. If such Declaration and Release are not returned within the specified time period, winner notification is returned as undeliverable, a potential Prize Winner fails to correctly answer the mathematical skill-testing question or a potential Prize Winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor's discretion, a runner-up may be selected.

5. PUBLICITY GRANT: Entry in the Contest constitutes permission for Sponsor, Tim Hortons and each of their respective designees to use each entrant's and Prize Winners' Entries, as well as entrant's name, website(s) or other social media handle or other ID, biographical information, address (city and province) and likeness, for advertising and promotional purposes, in any manner, in any and all media now or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission, except where prohibited by applicable law and as otherwise provided herein. The preceding expressly includes, without limitation, any video associated with any winning Entry. In addition to the foregoing, the entrants and Prize Winners acknowledge and agree that winning Entries will form part of an existing story (collectively, the "Story"), in conjunction with Section 7 outlined below, fully consent to any and all forms of exploitation of the Story and the Entries (in whole or in part), for no additional consideration.

6. PRIZES: The four (4) winners will be considered Prize Winners, and will each receive a Tim Card® gift card, valued at $100 CAD. In addition to the foregoing gift card, the Prize Winners will also receive:

● The publishing of their winning Entry as part of the Contest story

● Dedication of each week's chapter to that week's Prize Winner

● A shout out on the @TimHortons profile on the Platform.

Prize Winner(s) will have no approvals over the final messaging used in conjunction with any winning Entry or its content. Tim Hortons reserves the right to edit, interpret, translate, or otherwise make changes to any Prize Winner's Entry as Tim Hortons sees fit, at its sole discretion. All other prize details are at Sponsor's sole discretion. All federal, provincial, local and other taxes are the sole responsibility of each Prize Winner. Prize(s) must be accepted as awarded and may not be substituted or transferred, except at Sponsor's sole discretion. Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Any other costs, taxes or expenses associated with a prize not specified herein will be the responsibility of selected Prize Winners.

7. INTELLECTUAL PROPERTY/USE OF ENTRIES:Each Prize Winner grants and assigns to Sponsor and its designees all rights, title and interest of any kind or nature whatsoever in and to the winning Entry, including, without limitation,the right to use, perform, exhibit, reproduce and/or otherwise exploit his or her prize-winning Entry (on its own, and/or in conjunction with the Story) in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to entrant. The preceding grant of rights is subject to any rights retained by a social media operator in its social media platform. Each Prize Winner further waives, to the extent allowed by law, any "moral rights" of authors or similar natural rights of ownership the entrant may have in the Entry and the Story. Each Prize Winner further agrees, upon Sponsor's request and without compensation of any kind, to execute any additional documents so as to effect, record or perfect the grant of rights contemplated by this subsection.

8. REPRESENTATIONS AND WARRANTIES:

a. Each participating entrant hereby represents and warrants that any Entry and other materials and information provided by such entrant are original to entrant and do not violate or infringe upon the copyrights, trademarks, rights of privacy, publicity, moral rights or other intellectual property or other rights of any person or entity, and do not violate any rules or regulations contained in these Official Rules. If the Entry or information or materials provided by entrant contain any material or elements that are not owned by entrant and/or which are subject to the rights of third parties, entrant represents he or she has obtained, prior to submission of the Entry and information or materials, any and all releases and consents necessary to permit use and exploitation of the Entry and information and materials by Sponsor and Tim Hortons in the manner set forth in these Official Rules without additional compensation.

b. Each entrant represents and warrants that the Entry and materials and information provided do not contain information considered by entrant or any other third party to be confidential, and that the Entry, materials and information provided do not violate any applicable laws or regulations. Entrant agrees that Sponsor has the right to verify the ownership and originality of all Entries. In the event a submission is selected as a winning Entry, and entrant's ownership, rights and the originality of the Entry cannot be verified to the satisfaction of Sponsor or is in any other way ineligible, Sponsor may select an alternate winner based on the same judging criteria.

c. By participating, entrants acknowledge that Sponsor may be working on or receive other Entries (or Sponsor's employees or third-party independent contractors may create materials on their own) that are similar or identical in theme, format or other respects to that submitted by entrant. By submitting an Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor or Tim Hortons or developed by its employees or agents, or obtained from sources other than entrant. Neither Sponsor nor Tim Hortons shall have any liability to entrant for any direct, indirect, contributory, vicarious, secondary or other infringement or protection of any copyright in or to entrant's Entry. Neither Sponsor nor Tim Hortons are not responsible for any unauthorized use of Entries by third parties.

9. GENERAL RULES: In the event of a dispute regarding any Entry, that Entry will be deemed made by the authorized holder of the primary email address associated with the Entry at the time of the Entry submission, and such entrant must comply with these Official Rules. Sponsor, Tim Hortons, each of their respective parent corporations, affiliates, subsidiaries, and advertising, promotion and fulfillment agencies and all of their respective officers, shareholders, directors, employees, agents, representatives, licensees and assigns, as well as the Wattpad Star (collectively, "Released Parties") are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications, or forerrors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries or in any Contest-related materials. Released Parties reserve the right at their sole discretion to disqualify any entrant that tampers or attempts to tamper with the Entry process or the operation of the Contest, mobile application or website (including the Website); violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages (including attorneys' fees) and other remedies from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems. Released Parties will have no liability or responsibility for any claim arising in connection with participation in this Contest or the exploitation by a Released Party of any Entry. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest. Aside from providing portions of the Prizes and selecting the Prize Winners (as outlined hereto), Tim Hortons shall not be responsible for the conduct and administration of the Content, including the distribution of the Prizes. Entrants acknowledge and agree that Sponsor shall be the sole party responsible for the conduct and administration of the Contest.

The Released Parties have not made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By accepting a prize, each confirmed Prize Winner agrees to waive all recourse against the Released Parties if the applicable prize or a component thereof does not prove satisfactory, either in whole or in part. By participating in this Contest, to the maximum extent permitted by applicable law, each entrant: (i) releases the Released Parties from any and all liability, loss or damage that the entrant may incur in connection with the entrant's participation in this Contest and, if applicable, with respect to the awarding, receipt, possession and/or use or misuse of a prize and notifications in respect of prizes ; (ii) agrees that under no circumstances will the entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, consequential, or any other damages; (iii) agrees that all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (iv) agrees that any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.

10. RELEASE/LIMITATIONS OF LIABILITY: ENTRANTS HEREBY HOLD THE RELEASED PARTIES HARMLESS FROM AND AGAINST ANY THIRD-PARTY CLAIM ARISING FROM USE OF THE ENTRY, THE STORY, OR ENTRANTS' PARTICIPATION IN THE CONTEST, INCLUDING WITHOUT LIMITATION ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH COPYRIGHT, TRADEMARK, RIGHTS OF PUBLICITY OR PRIVACY OR FALSE ENDORSEMENT. RELEASED PARTIES ARE NOT RESPONSIBLE FOR LOST, LATE, DAMAGED, MISDIRECTED, ILLEGIBLE, INCOMPLETE, DELAYED, INACCURATE, GARBLED, STOLEN OR MUTILATED ENTRIES, OR FOR ANY COMPUTER, ONLINE, TELEPHONE OR TECHNICAL MALFUNCTIONS, DELAYS OR HUMAN ERRORS THAT OCCUR IN THE PROCESSING, TRANSMISSION OR RECEIPT OF ENTRIES, OR FOR INACCURATE TRANSCRIPTION OF ENTRY INFORMATION, OR FOR ENTRIES THAT ARE STOLEN, MISDIRECTED, GARBLED, LOST OR DELAYED BY COMPUTER TRANSMISSIONS, OR IF, FOR ANY REASON, THE CONTEST IS NOT CAPABLE OF BEING CONDUCTED AS PLANNED, INCLUDING BUT NOT LIMITED TO INFECTION BY COMPUTER VIRUSES, BUGS, TAMPERING, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR OTHER CAUSES. RELEASED PARTIES ARE NOT RESPONSIBLE FOR INCORRECT OR INACCURATE ENTRY INFORMATION, WHETHER CAUSED BY INTERNET USERS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE CONTEST OR BY ANY TECHNICAL OR HUMAN ERROR THAT MAY OCCUR IN THE PROCESSING OF THE ENTRIES IN THE CONTEST.

11. DISPUTES: This Contest and the rights and obligations of Sponsor and participants will be governed by and controlled by the laws of the Province of Ontario, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the City of Toronto, Ontario. entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will entrant be permitted to obtain attorneys' fees or other legal costs; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

12. USE OF DATA: Information submitted in connection with this Contest is governed by Sponsor's Privacy Policy (available at http://policies.wattpad.com/privacy), and by participating in the Contest, each entrant acknowledges that he or she has read and accepted the Privacy Policy and agrees to Sponsor's and Tim Hortons's usage of his or her personal information. Sponsor prohibits entry by, and does not knowingly collect personal information from, anyone under thirteen (13) years of age.

13. WINNER'S LIST: Anyone may request the names of the winners (available after January 1st, 2022) by sending a self-addressed, stamped envelope to Sponsor at the address below for receipt no later than January 15th, 2022.
