Case where a 5 year old girl gets sexually harassed by her uncle outside the front of his house results are out.

The Jury have deemed Park Jimin, age 23, GUILTY for Park Duri's sexual assault.

Park Jimin has been sentenced to life imprisonment (10 years) with parole*.

*Parole means Jimin can get out of prison earlier with promising behaviour in prison.

A jury member claims that the most convincing evidence towards Jimin's innocence was the claims of his sexual orientation being homosexual which would leave Jimin uninterested in a female body; such as Duri's.

However there is not enough evidence before the crime to convince the jury.

Park Jimin's lawyer spoke with us briefly in the Seoul court car park, saying "Park Jimin is not guilty, I do not stand by the results of the Jury, Park Jimin was just at the wrong place, at the wrong time."

However crime files suggest the defendant is guilty due to the parents of Duri, claiming to walk into Jimin's house, to see their young girl crying as she cried out that "He touched her."

This case has spanned out across multiple weeks with bare minimum evidence gathered.

But every piece of evidence is linked to Park Jimin, whether this is because the crime happened on his property or whether Jimin did commit the crime, he has been found guilty.

We tried to speak to Jimin's family when the results were revealed, only Jimin's brother waved us away and did not want to speak to us.

Jimin's POV

My breathing was very slow.

I could hear the entire court erupt with their comments and opinions of me.

Only I just couldn't believe it.

I knew that there was not a lot of evidence supporting me, however I did not commit this crime and now I am in jail, only with the burden that I was found guilty for sexual harassment towards a 5 year old girl, who's my niece so that would be incest.

My eyes just stared at the judge who'd announced the court of the Jury's decision just moments ago.

I just lost my entire family, all in one go.

But I'm mostly upset about not being able to see Duri.

I will have a restraining order from being in contact with my niece.

I will not get to see her grow up, nor tease her about getting a boyfriend when she gets older.

I'll miss out on seeing her in little fairy dresses and playing hide and go seek with her.

I will miss out on seeing her black pig tails that bob around while we run around my house, and seeing her face light up when we decorate cookies.

I will miss out on everything with her.

A tear dripped down my cheek without me even being aware of my clouding over hazel orbs.

I got escorted out of the room, my hands now shaking as my tummy riddled with butterflies, only these were not nice feeling butterflies; these were ones that made your stomach flip, churn and roll about like a washing machine.

I was expecting to be led straight out of court to a police vehicle but instead I was escorted out the back of the court and into a bare room.

A police officer shoved me down into a seat that was in front of a basic empty wooden desk.

The seat was a gross burgundy colour that was deteriorating and itched on bare skin.

I stared at the seat opposite mine that was currently empty.

Who could I be meeting with?

My brother?

The judge?

A couple moments later, my answer was revealed as my lawyer strolled in, walking around the table to sit in front of me.

She pulled her black bag off from one of her shoulders, placing it on the ground before pulling out a black folder which had many white papers inside.

She flipped through the papers before stopping as she looked down at a page.

I raised my eyebrow at the women, wondering what was going on.

Does she have some evidence that is too late?

Does she want my bank details so I can pay her?

She finally looked up, making eye contact with me.

She seemed to search my eyes, maybe for some emotions, some shame, or some confession as though she presumes I did commit the crime.

"How- How are you feeling?" She asked me, her voice sounding mellow up close.

I lightly snickered before answering, "As anyone who would get sentenced for sexual harassment for a young relative when you are gay and have no interest in a women and know you have lost a chance to spend time with your niece across life. So I'd say that I am doing pretty shit."

She nodded slowly after hearing my flow of words.

"Would you like to speak to a counsellor?" She asked me afterwards which made me furrow my brows.

"No, no I am fine." I stuttered.

"It may help, they have services in prison and sometimes if you are bad enough, you get a dairy or get sent to a mental hospital which can give you medicines to assist your mood." She explained.

"I don't need a hospital. I just need to process things, but if you think going to a counsellor or getting a dairy would help, then just sign me up." I said flatly.

She nodded.

"Now what is this really about? Because I don't believe you are also a counsellor that is here to ask about my feelings all day." I hummed.

She spun the paper around that was in front of her moments ago.

My eyes cast down over the black inked page.

The words 'Inmate Possessions' ran across the top of it.

"Have a read, but basically you have some decisions to make regarding your personal property, such as your house or car. Usually families may deal with your property for you and sell it but that seems a bit hard when they do not want much to do with you currently." She explained.

"I have to sell my house?" I gasped while reading the paper.

"It wouldn't seem that useful that an inmate has a house with no one to do maintenance to it or anyone living in it for many years." She explained.

"But I like my house." I whined while pouting.

"You can buy it back again when you get out of prison if it's up for sale then." She stated.

"But it may not be." I protested.

"Park Jimin, you have to sell your house because you don't even have a partner living in it. If you did, I'd give them rights to your possessions but you don't." She snapped.

"I mean I do but he's also in jail." I said under my breath.

"Exactly." She muttered.

"You can either put your house items up for sale too, or you can just store them in a shipping container, but that'd cost you yearly and by the time you get out of jail, you may not have much money to use while restarting your life so I would encourage you to let go of most possessions." She directed.

"I don't want to keep things like my couch, just photo's and such." I responded.

She nodded, writing that down on a fresh piece of paper that she got out of her bag with a basic blue point pen.

"And are you happy to sell your car as you won't be using it for a while?" She questioned.

I sighed while nodding.

"Okay, I'll require your signature here and here," She said while pointing at spots.

"And I will sort out saving your possessions that are like images, if you think of anything else valuable that you want to keep or have memories with or of, please let me know asap, you can just ask the prison guards to speak with me, otherwise I will confirm with you once everything is sold and what has been kept," She went on.

"Plus I'll come see you guarding anything new that pops up, such as possibly a restraining order that needs your signature." She explained.

I pouted while nodding.

"Alright, you are free to go." She announced.

As much as the chair I was sitting on was itchy, it at least was padded and was unlike every other seat that has been made from concrete or a hard material like my bedding.

So when I got lifted up by a guard under one of my armpits, I felt everything daunting on me.

I will saviour the feeling of comfort that I will not get again for quite some time.

I am not a heart stabber, just a seriously misunderstood inmate who wants to see his niece. I should be free, free from the madness of Seoul's "finest hotel" with the horrific price of my freedom...
