Jimin's POV
"I'd like to speak to the defendant, your honour." Duri's lawyer said steadily into the mic.
My heart leapt out of my chest as I felt the heavy metallic cuffs loosen out of a plastic clear padlocked box that was attached to my desk.
I stood up slowly, my hair was a blonde mess, covering my eyes slightly as I walked towards the door on my booth.
A guard opened it and I was followed by a guard right up to the witness speaking stand.
I sat down and cast a glance at my younger brother whose face was blank and remorseful before the plaintiff's lawyer began speaking into her microphone.
"Park Jimin, where were you when the crime was committed?" The lawyer asked me.
"I was inside my house." I replied into the microphone in front of me.
My heart skipped a beat seeing Duri's head look up, hearing my soft voice echo around the room.
"And you live at 18 Kimland street, correct?" The lawyer asked me while looking down at the papers of my address.
"Correct." I replied.
"Park was inside his house when the accident happened so doesn't this rule him out?" My lawyer questioned while looking at the judge.
"But what if the accident didn't happen outside like we have been investigating. Or what if he is lying." The plaintiffs lawyer said, cutting off the judge's reply.
"Continue." The judge said into his mic making me sigh with the continuing questions.
"Mr Park, where were you when Park Duri spoke to her parents about the accident?" The lawyer asked me.
"Inside my house." I replied.
"And you stood there doing nothing while Duri cried to her parents about what had happened, correct?" The lawyer pushed.
"I was in shock." I replied into the microphone while feeling my eyebrows furrow with frustration.
"Mr Park, that wasn't the question I asked. You stood there doing nothing while Duri cried about what happened to her parents, correct?" She asked.
"Yes." I replied while rolling my eyes.
"What part of the house did this take place in?" The female plaintiff lawyer quizzed.
"My lounge." I replied calmly again.
"And you claim the accident took place in your front yard?" She asked.
"Yes." I replied.
"If this was so, how come the plaintiff was inside your lounge room to tell her parents what happened?" She asked.
I scoffed before answering, "The front door leads into my lounge area. Duri ran in to possibly tell me but then her parents walked in a minute after and she told them instead." I stated.
"How come she told her parents and not you if you didn't do it and if you were alone with her for a minute?" She asked.
"I didn't see her come inside because I was on the treadmill in my house so I presume she didn't tell me because I was busy." I stated.
"But you just told me that she came inside through the front door. How would you know this if you weren't paying attention to her while on the treadmill in your lounge?" She asked.
"The door banged against the wall, I knew she came back inside." I replied.
"How old is Duri?" She asked.
"5 years old." I answered after counting on my small stubby fingers.
"And you left a 5 year old to go outside around 19:00pm to 19:30pm when it's dark out all by herself?" She asked while checking the times Duri had gone outside.
"Yes." I said while clenching my fists inside the handcuffs.
I do know that it sounds bad.
"What were your motives for letting a young girl go outside that late at night?" She questioned.
"She's a child, she likes to play with toys and run around outside." I spat.
"But she can play with toys and run around inside your house too?" She suggested.
"She can, yes." I replied.
"So is it possible that Mr Park assaulted Park Duri from inside the house when she was playing and never went outside that night. That's all I have to say to the defendant, your honour." She said, making my eyes go wide.
"Objection, I'd like to speak to the plaintiff to find out if this information is plausible." My lawyer spoke.
"I'd allow that." The judge replied.
I looked to my side, seeing a guard nudge my arm.
I stood up from the black seat that was behind the witness stand and walked back to my cubicle, still followed by a guard who locked me back into a table.
Only my heart was racing to see my brother walk Duri up to the stand.
He left her sitting on the chair on her knees in front of the microphone before heading back to his seat.
Today she wore a cute pink long sleeve shirt with a yellow toy duck in the centre, along with some light violet leggings.
"Hi Duri, do you mind answering whether you went outside last week when you stayed at your uncle's house?" My lawyer asked.
"I went outside, yes." She said.
Making the entire audience gasp.
"May I speak with the plaintiff also your honour?" The female plaintiff lawyer asked.
"I accept." The judge spoke.
"Duri, did you go outside at night time?" She asked.
"I did." The young girl replied, making me sigh in relief.
"What happened outside Duri?" The female lawyer continued.
Is she allowed to even ask her that? Isn't it a sensitive topic for her currently?
"He touched me." She said, her soft bottom lip quivered.
"Where did he touch you?" She continued.
"My... My chest..." She said slowly.
My heart sank.
I seriously couldn't believe who'd do such a horrible thing to my niece.
I felt like crying hearing what actually happened to her.
"Anywhere else?" She asked her.
"A place similar to my mummy, the place where I came out of." She replied with a goofy smile.
Only it hurt so much more hearing this.
"And who touched you Duri, was it your uncle?" My lawyer asked for her to clear it up.
There was silence as though Duri didn't understand the question.
"Did your uncle touch you that night?" The plaintiff lawyer now asked, seeing her not answer.
"Yes. We played wrestling." She said while beaming again.
I couldn't help but grin from seeing her gums with her small baby teeth showing, only one tooth from the left side was missing from her mouth.
"But who touched your chest, can you describe him to me Duri?" The plaintiff lawyer asked.
"Skinny, taller than me." She simply replied.
"But was it your uncle?" The lawyer asked.
Duri's head tilted cutely to the side as she glanced at me then looked back at the lawyer with eyebrows knitting together.
She's going to say no.
But the silence makes me think she doesn't understand.
"Yeah my uncle touched me that night." She responded.
My mouth fell open to her response.
"She doesn't mean for it to sound that way!" I yelled before lying my head down on the table feeling extremely distressed.
"I think we will call it a day." The judge announced making my heart do summersaults.
No-no-no, this just couldn't be happening could it?
I sound so guilty and I'm not even guilty.
They are successfully making me sound guilty.
My innocence is disappearing quickly.
But what can I do? This entire case is beginning to stab my heart, leaving it teared and broken... God Duri, why are you making my situation seem worse when you smile so happily at me... Does she even know how much pain she's causing me? My heart aches for her, but it beats for someone else...
