Chapter 17
The following week, December 10th, David was finally asked to provide his testmonies. His smug face could make anyone sick. David was his own defense on the witness stand.
"I simply did not have anything to do with her death your honor," David told the judge and prosecutors.
"Did you or did you not have any contact with your brother Richard the day before Debbie's body was found?" Davids attorney William Whitewash asked him.
"No I had no contact with him. I didn't talk to him at all," David said pushing his glasses up.
Detective May, sitting in the court, noticed David pushed up his glasses when he got nervous or got caught in a lie.
"We also ask you Mr. Kingston, when you were first arrested on June 14th, later in jail, you proclaimed and proudly discussed how you cleanly "slayed your wife," Whitewash contiuned.
"No, those are innuendos," David replied with an attitude.
"Now tell us Mr. Kingston, did you ever lay a hand on Debbie in other words, abuse her?" Whitewash posed the question.
"If any such things happened towards Debbie, it was accidental and most of what witnesses testified to previously just simply didn't happen," David said clasping his hands.
"Mr. Kingston, did you kill your wife?" Whitewash asked David.
"No I did not," David replied.
"Did you have anything to do with her death?" Whitewash asked turning his head.
"Absolutely not!" David said.
"Well then Mr. Kingston, how did you spend the day of March 27th," Whitewash instructed David.
"It was like any normal day. I was doing some business errands for my friend Don Como who owns the video store off of Comanche. I usually help out with technical stuff, I'm sort of good with that stuff," David stated.
"That overlaps with the time frame Richard testified to of seeing you, correct?" Whitewash asked.
"Yes sir. I never saw Richard that day," David replied.
Richard, who was sitting in the court, sighed annoyed.
"We call to witness with David, Don Como," Whitewash asked.
Como was sworn in and he provided receipts and a check with time stamps to back up what David said he did.
Deputy District Attorney Andrew Roberts halted them right there as Roberts detected a discrepancy.
"Your honor, please hold as Como is not saying exactly what he told Detective May on November 23rd," Roberts told the stand.
"Go ahead Mr. Roberts," Judge Francis Arthur told him.
"Your honor, those receipts are time stamped 1:30pm. Richard saw David at 1:30pm which survelliance from the store backs up Richard's account. I also want to show you that check Como provided, do you see how it was whited out and a forged check?" District Attorney Roberts said.
"So the evidence is faulty," prosecutors said.
"Let's go back to the abuse allegations Mr. Kingston," Whitewash said.
"I did hit Debbie once. It was an accident. She was slapping me and I brought my arm up and struck her sort of hard," David said.
"Are you saying Debbie deserved to be struck?" Whitewash asked.
"Yes, I was defending myself," David told Whitewash in response.
"Anything else you want to add?" Whitewash pondered.
"Well one time I was trying to give her a hug and she backed up against the wall," David said.
"Were you trying to sexually induce her?" Whitewash asked.
"No, I was offering her the hug as we just had fought in front of our sons," David replied.
"Ok Mr. Kingston, that will be all for now," Whitewash told David.
Next to the stand was Donny, Debbie's brother.
"Mr. Matthews, please begin your statement," Judge Arthur and the prosectors instructed.
"Your honor, to start off, I was with David the night of March 27 till about 1:30am the morning of March 28th. After that, I was with my wife, Dora and we were kicking back after a long day. I had not been in contact with David for 5 days when he brought me, unknowingly to "case" my sister's Taylor Ranch home on March 22nd, when he jumped the fence," Donny said relieved.
"Go on Mr. Matthews," they told him.
"Going back to March 22nd, it was evident that we were there for unknowing reasons I respect a mans privacy," Donny contiuned.
"What else?" they asked him.
"When I arrived to the Taylor Ranch home after her body was found, David said, "it looks like she really did it this time." David also kept saying as well that it was accident or perhaps a suicide or perhaps her heart quit beating or something like that," Donny said.
"Did you ever suspect David did it?" District Attorney Roberts asked Donny.
"Yes I did your honor," Donny responded.
"Did you ever see signs of abuse?" Roberts asked Donny.
"No sir and I know that is different then what my brother Sean testified. I wasn't as close to Debbie after she got married," Donny explained.
Testimony shifted to the district attorney investigator and they brought up the driving times between the houses.
"In September, though I did not consider roadwork at the time, the test drive between the Taylor Ranch home and Kingston's mother's house and Donny's house to and from was approximately 11 minutes to one and 12 minutes to the other between the hours of 1:30 pm and 2:30 pm," the attorney testifed.
"Under cross-examination, however, we cannot verify again the road construction possibility but have a word into the city of Albuquerque on if there were plans on any major streets Mr. Kingston used to get from here to there," District Attorney Roberts testifed.
The trial went to rest till the next day. Detective May believed that next week, the jury would have a verdict. David was slipping up at the risk of his own hands. Justice was close.
