December 3, the second day of the trial, the focus testimonies were on David's brother Richard and Debbie's colleagues.
Police contact with Richard dates back to June 1990, which led to David's intial arrest. However, he was later let out on bond as we know.
Richard opened up with the testimony that, "David confided in me on the day before his wife's body was found that they were going to find her in the bathtub and think it was a suicide."
Prosecutors asked, "Why did it take so long for you to come forward with this information?"
Richard swallowed hard, "Because I was afraid for my own life. If he had the nerve and no remorse of killing his wife, he could kill me."
"So that's why you went to church elders and made a confession at the end of May 1990?" they asked Richard.
"Yessum. I thought if I did anonymous, it would be better so David didn't know I would be in contact with the police," Richard explained.
David kept making eye rolls every time Richard talked.
"What was it about David's alibi that his mother had claimed and told you?" they integrated him.
"Our mother told me that David wasn't home in the early hours of March 28th, but at 5 a.m he was in bed," Richard told them.
"What was it about Debbie seeing another boyfriend?" Prosecutors asked Richard.
"When I ran into David at the discount store the day before his wife's body was found, David also told me that she (Debbie) was seeing another boyfriend and it made him very upset," Richard explained.
"Well what about this "boyfriend?" " they continued asking Richard.
"David told me the evening of March 27 that one of Debbie's boyfriends was going over that evening to her house and that he (David) was going to follow him and kill him and that Debbie was next. They would find her dead in the tub and think it was suicide," Richard explained while locking eyes with David.
David of course was cocky and clasped his hands and looked at his attorney, Whitewash.
"What happened after they found her body?" Prosecutors questioned.
"When I saw David after they had found Debbie's body, David acted kind of weird," Richard explained.
"Weird?" they contiuned on.
"Yessum, David explained that it was "awkward" what happened to her and said she must have died from a heart problem she had. David said it was Donny Matthews (Debbie's brother) idea that she died that way," Richard replied.
"So with the earlier information that you provided the elders plus your testimony, do you believe your brother, David Kingston, is guilty of murder?" Prosecutors popped the question.
"Yes I believe so. He underhandly had something to do with Debbie Kingston's death with his sloppy work," Richard claimed.
Richard's testimony was over and they brought to the stand one of Debbie's former collegues, who was close to Debbie, Mrs. Janet Fergueson. Her main testimony was to prove the abuse allegations brought up in interviews.
"Mrs. Fergeson, what have you seen in regards to signs of abuse on Debbie?" the proseuctors asked.
"She was absolutely afraid of David. Once, when we were alone, Debbie just let go and started crying. On this specific day, she confined in me that morning before coming to work, her and David got into a fight. David got angry and threw her makeup on the floor and then grabbed her by her hair and rubbed her face in it," Fergueson testifed.
They next moved onto Destiny Sanchez, Debbie's nextdoor kindergarten teacher and she also taught Daymon.
"Miss. Sanchez, you claimed of a time David chased Debbie to the classroom?" the prosecutors opened up the testimony.
"One time prior, Debbie came to class with a bruise on her cheek. Later in the week, Debbie was being chased to class and David was being agressive towards her. He ended up grabbing her arms and pinning her against the door," Sanchez explained.
"That will be all, thank you," they told Sanchez.
Next was Debbie's assistant, Doreen Liberman.
"One time, Debbie came to school with a black eye and swollen lip. One time we were visiting pupils of ours with parents in the parking lot and David would often appear, circling in the parking lot. It would often make Debbie very nervous and shaky, " Liberman explained.
Prosecutors went through several other testimonies about the abuse. A long time friend anonymously testified that early in the marriage that Debbie often would have random bruises and in late 1989, it got worse.
Closing arguments followed and the trial was adjourned for the day.
