December 2nd, 1991 came with a early sunrise. The crisp cool air filled everyone's bones with uneasiness.
Attorneys began the process in the murder case. The trial was in district court. Testfying in the opening of the case was neighbor Joanna.
"What exactly happened when you were called on the morning of March 28th?" Prosecutors inquired Joanna.
"David Kingston telephoned me quite concerned because his children couldn't find their mother," Joanna explained.
"So what did he ask you to do?" the prosecution continued.
"He called me after talking to Daymon that he would let me in," Joanna said calmly.
"What happened after Daymon left you in?" they contiuned.
"I made a horrible discovery. Debbie Kingston, 30, was dead in the bathtub. I had to use a barbeque skewer to open the bathroom door," Joanna said.
David was smug and acting arrogant like she was lying.
"Then what?" Proseuctors contiuned.
"She was not moving," Joanna said in response.
"Did Debbie's children see her?" they contiuned on.
"Daymon did, but after I made sure they were in another room safe, I proceeded to call emergency and the police," Joanna said while looking right at David's weasel face.
"What else happened while you were there?" the prosecution contiuned.
"Well I saw when David arrived at the Taylor Ranch home, he was very very upset and seemed broken up over his wife's unsettling death," Joanna told them.
"So we want to conclude from Joanna that she's saying Kingston killed his wife," they responded.
During testimonies, District Attorney Andrew Roberts brought up three extramarital affairs that Debbie so called had. A statement brought to the court said that Debbie claimed they separated and David's roles as husband and father were in "jeopardy."
Defense William Whitewash said that his client, David Kingston, was with Debbie's brother Donny Matthews and then he was at his mother's house, where he was living.
Only one can imagine Donny's reaction. He was beyond upset.
"I WAS NOT WITH HIM!" Donny yelled from the court.
"Order in the court," Judge Francis Arthur used his gabble to bring attention to the court.
Joanna and the first policeman on scene Officer Ryker Chavez on entering the Kingston house smelled a strong odor.
Another detective on the scene was Detective Gerald Walker testifed that once the investigation started, a can of engine starter was found in the garage on the floor. Once examined, the ingredients in the engine starter contained ether. Walker stated later on that they did dust prints and it showed it had recently been on a shelf in the garage.
Officers testified that yes, at first, they were called out on a suspicious death, which many times was suicide. Due to Debbie's family and other neighbors finding out she had been killed, officers had a hard time securing the scene. It wasn't until the afternoon that they secured the Kingston Taylor Ranch Home and it turned into a homicide investigation.
Whitewash challenged these and brought to the table, how reliable was the evidence collected?
Evidence presented to the jury was first off was the whiskey bottle found in the kitchen and the glass of whiskey found in the bathroom where Debbie was found.
Officers also testifed the glass stopper (not perfume bottle as first thought) Debbie was clutching. Why would she have left the bottle of whiskey in the kitchen and taken the stopper and glass of whiskey with her?
They also found a love note from Debbie to somone. But, cross-examination show'd the love note was David's handwriting.
Proseuctors also testifed that David had reason to kill her because of financial gain. It was revealed that Debbie had a $100,000 life insurance policy plus a maturity. This easily could have pushed David over the edge.
Other witnessess testifed too that David had physically abused Debroah. This was cross examined and proved that this was true due to the incident at Harley and Zelda's house a few months before the murder. Some testimonies called David a "domineering" husband. David, of course, denied any of these allegations.
District Attorney Andrew Roberts stated to the jury while pointing at David , "Ladies and gentleman, there's the liar."
Roberts continued on, "Combine with motive and other factors, now you have not just a wife-beater, what you have is a murderer."
Attorneys focused on closing arguments on the first day focused on key timing of David's "alibi." Private investigators had investigated David's place of employment and found out David was a fast driver. They had nicknamed him "Rocket Kingston." So it was possible David was able to get to the Taylor Ranch home, kill Debbie, and get back to his mother's Northeast Heights home in the allotted time.
Before the first day of the trial was over, they also focused on the testimony of David's brother, Richard.
David told Richard on March 27th, at a local Target, that "they were going to find her in the bathtub and think it was suicide." Richard would testify on the second day of the trial his whereabouts and his knowledge. District Attorney Andrew Roberts told the jury that Richard "had nothing to lose in this situation."
Arguments closed and everyone went on recess till tomorrow for day 2 of the Kingston murder trial.
