Chapter 14
November 25th, 1991. 3 days before Thanksgiving, jury selection begin for the trial of David Kingston. It was a Thanksgiving miracle for the Matthews to find out that David was finally being put on trial.
The jury selection was made up of 9 women and 7 men. They were selected with no problems. Judge Francis Arthur was selected to lead the trial. Testimonies are to begin December 2nd after the long Thanksgiving weekend.
On December 2nd, the Chief Deputy District Attorney Andrew Roberts wants to open the case initially to show the slow deterioration of Debbie's and David's relationship.
Attorney William Whitewash said the defense is "we didn't commit the murder of Debbie Kingston."
Court documents show that David Kingston intends to call witnesses to testify that he was else where March 27 and 28th between the hours of 10 p.m and 7 a.m.
The court also showed that David and Debbie were married on January 2nd, 1982 and Debbie filed for divorce due to incompatibility on January 8th, 1990.
Daymon is now 8 and the twins Dustin and Daniel are now 5 1/2.
District Attorney Andrew Roberts also believes the trial could last up to a month. Detective May was sure it wouldn't last more then 3 weeks with the key evidence and with David's testimonies. If David would lie in closed interviews, May knew he would lie on the stand.
On a positive note, earlier this past week the Albuquerque Public School Board Members unanimously voted to rename the Mojave Elementary School Media Center in honor of Debbie. This made the Matthews family full of emotions. In our hearts, Debbie's memory will never die. Principal Morgan Bradley of Mojave Elementary had a plaque engraved to be hanged in the media center which read "to live in our hearts we leave behind is not to die."
In this week as well, we found out Debbie raised over $4,000 of her own money for her classroom reading program for books and furniture.
On the afternoon of November 26th, the jury was sworn in and ordered to come back Monday morning to hear opening statements and start of testimony.
David of course plead his innocence and didn't see the need for a trial. His mother Mia was going to testify and we shall sooner then later see Mia slip up in her defense.
The Matthews family was apprehensive that David wouldn't be found gulity. Due to the high publicity of the case, the jury possibly had their own conclusion about David. Perhaps, people could think Debbie was at fault due to the circumstance of the impending divorce. If anyone had a sane mind, they would know David Kingston was guilty by looking at his Jeffrey Dahmer looking face.
Detective May talked to Harley and Zelda once he knew the jury was swore in. Zelda was relived to know there was more women on the case because that might help encourage a guilty verdict if they can put themselves in Debbie's shoes. Harley believed any true man would cry and find David guilty with the evidence, photos, and interviews.
One thing Zelda was thankful for was that this Thanksgiving, the Matthews were one step closer to justice for Debbie. Like last Thanksgiving, the Matthews kept a space open for Debbie but this year, Zelda said the prayer.
"Dear Lord,
We want to send our gratitude to you as you have gotten us one step closer to getting justice for Debbie.
We want to say our thanks for providing us with the love and shelter you've surrounded us.
Please provide David with his due karma. What he dishes out shall he get back in return.
Debbie, you are always in our hearts and we miss you dearly. Daymon is in 2nd grade now and the twins are now 1st graders. They miss you so much.
We love you Debbie and you lord.
Amen," Zelda spoke the prayer.
With the end of Zelda's prayer, the Matthews commenced the Thanksgiving dinner.
It was a somber Thanksgiving, knowing that starting next week, Debbie's justice would begin.
Detective May was somber as well. He wasn't sure how this trial was going to go. He didn't want to be made a fool once the trial started. He knew David's charming, deceitful ways and was worried that once David is on the stand, he could convince the jury he was innocent. That's why it's key that Detective May is able to pull Richard, David's brother for testimony shortly after they have David testify.
Debbie's justice was only just beginning.
