Chapter 13
Time passed by before Detective May was able to break the news to the Matthews that David's trial would be held in December. It was currently August, 1991. Prosecutors were gathering the defense, witnesses, testimonies, etc that would be in the trial. David was back out free after his petty offenses.
Detective May wasn't pleased with the judge who let him out again on bond. But, that would be changed hopefully sooner then later. People begun saying Detective May was nothing but a liar. And guess who those people were? David's mother Mia and David's new girlfriend, Jill Hernadez, David's Aunt. That just makes this case even more horrifying.
David wasn't backing down from his alibis. He swears he didn't kill Debbie. But, David's brother and the inmate from the detention center have convincing allegations that we know David did it. Detective May knew that once the process for the jury selection was to start, it would be a difficult one to have a gulity verdict.
Detective May gathered all the tapes and evidence into a big file and this would be presented to Judge Francis Arthur to move forward with the trial proceedings. May whole heartedly believed David would be sentenced come January 1992 as long as the verdict read gulity.
Zelda and Harley were relived to know that the trial would happen in a few months. The only hard part was having to stand on witness stand and see David's smug, guilty face.
May informed Zelda and Harley that in their testimonies that they would need to discuss the abuse that they may have witnessed prior to the divorce papers. May also wanted Zelda to openly discuss the time David broke into the Matthews home just a few months before Debbie was killed.
David had cut the phone wire and beat on Harley. He then took the boys and left in Debbie's minivan and fled. Zelda had to jump the wall to get to her neighbors to get help and Debbie had fled the house and was already there at the neighbors in fetal position mumbling, "I'm never going to see my children again. He's going to kill me."
Detective May figured that if he had the testimonies of the victim's family, the guilty verdict would be easy to serve.
If after all this evidence was served, May prayed that justice would be served.
Donny and Richard were also asked to testify in the trial in a few months and of course they said yes. Richard's testimony could be the final nail in David's coffin.
Donny's testimony may make himself look guilty with the March 22nd incident.
May was aware that Donny's testimony may provide inadequate evidence, but seeing it from a different perspective for the jury may benefit the guilty verdict on David's behalf.
May also wanted Debbie's colleagues to testify too. Destiny Sanchez, Debbie's next door kindergarten teacher at Mojave Elementry School and Daymon's teacher, was one who agreed. It would be important for the trial because when Destiny had been interview, she provided key witness to a time David chased Debbie to her classroom and forcefully grabbed her arms.
Debbie's boys were left out of the trial when it came to witnesses or testimonies. During the trial, they would play the recordings of Daymon's interview with Detective May. Daymon didn't provide anything criminally about his dad, but the daze and confusion of the child can provide insight to the jurors of what kind of animal David was.
A key piece of evidence that was needed but no one could find it was the item David used to administer the ether. Prosecutors were hell-bent on finding it or coming up with an idea of how he could have done the ether to Debbie so the jury would see how she got burns on her face and minor cuts.
May also wanted to make sure the jury would know how full the tub was where Debbie was found the morning of March 28. The tub was 3/4's full, meaning David carefully had the killing planned out for a while. It wasn't a cover-up, he knew exactly what he was doing. David could deny it, but his messy footsteps and mouth would be the telling sign he was a killer.
While looking at the house pictures provided by Harley and Zelda, May noticed something else odd. When Debbie and David first bought the house, the driveway had a motion light above the garage.
On the first day of the investigation, and pictures taken on the day of the crime by APD, the motion light was missing. May concluded David , on a night where Debbie wasn't home or she was at work, uninstalled the lights without her permission. However, Debbie never got them reinstalled as they were in the garage when investigators went through the house on March 28.
David wasn't stupid, but wasn't a very smart criminal either. He was messy with his work, especially not crying at the funeral. That still sticks with Detective May.
The trial was in sight. The Matthews would soon be on witness to provide justice to the sweet soul gone too soon.
